Monthly Report of Sustainability Assessments

The Monthly Report of Sustainability Assessments (SA) lists the titles, brief descriptions and sustainability implications of new public policies and proposals that went through the SA process and were made known to the public through LegCo briefs or press releases etc. during the report period. Internet links to the relevant background documents are also provided.  


REPORT PERIOD : February 2024

Town Planning Ordinance (Chapter 131)
Approved Fanling/Sheung Shui Extension Area Outline Zoning Plan No. S/FSSE/2 [LegCo Brief]

At the meeting of the Executive Council on 6 February 2024, the Council advised and the Chief Executive ordered that the draft Fanling/Sheung Shui Extension Area Outline Zoning Plan (OZP) No. S/FSSE/1A, should be approved under section 9(1)(a) of the Town Planning Ordinance. The plan is now renumbered as S/FSSE/2.

Sustainability Implications: As far as sustainability implications are concerned, the draft Fanling/Sheung Shui Extension Area OZP No. S/FSSE/1A provides a planning framework with appropriate zonings and planning control for the Area. In particular, the “Other Specified Uses” annotated “Conservation cum Recreation” zoning could facilitate the conservation of the existing natural landscape and ecological features and the provision of passive recreational uses.

Town Planning Ordinance (Chapter 131)
Approved Tusen Wan Outline Zoning Plan No. S/TW/37 [LegCo Brief]

At the meeting of the Executive Council on 6 February 2024, the Council advised and the Chief Executive ordered that the draft Tsuen Wan Outline Zoning Plan No. S/TW/36A, should be approved under section 9(1)(a) of the Town Planning Ordinance. The plan is now renumbered as S/TW/37.

Sustainability Implications: As far as sustainability implications are concerned, the development could facilitate better utilisation of land resources to meet social needs. The proposed columbarium development may generate potential environmental impacts on the local area, and suitable mitigation measures should be implemented to alleviate any such possible impacts.

Town Planning Ordinance (Chapter 131)
Approved Urban Renewal Authority Kau Pui Lung Road/Chi Kiang Street Development Scheme Plan No. S/K10/URA2/2 [LegCo Brief]

At the meeting of the Executive Council on 6 February 2024, the Council advised and the Chief Executive ordered that the draft Urban Renewal Authority Kau Pui Lung Road/Chi Kiang Street Development Scheme Plan No. S/K10/URA2/1A, should be approved under section 9(1)(a) of the Town Planning Ordinance. The plan is now renumbered as S/K10/URA2/2.

Sustainability Implications: Regarding sustainability implications, the proposed redevelopment could facilitate better utilisation of land resources to meet housing and social needs. As the proposed redevelopment may generate potential environmental impacts on the local area, suitable mitigation measures should be implemented to alleviate such possible impacts.

Lands Resumption Ordinance (Chapter 124)
Resumption of Land for Drainage Improvement Works at She Shan, Tai Po, New Territories [Press Release]

On 23 February 2024, the Lands Department announced the proposal for resumption of land for drainage improvement works at She Shan, Tai Po, New Territories under the Lands Resumption Ordinance.

Sustainability Implications: The proposed land resumption will facilitate the proposed drainage improvement works to alleviate flooding hazards and upgrade the drainage system to the prevailing flood protection standard. Suitable mitigation measures will be implemented to minimize the environmental impacts. The sentiments of stakeholders should be handled with care.

Inland Revenue Ordinance (Chapter 112)
Inland Revenue (Amendment) (Tax Concessions and Two-tiered Standard Rates) Bill 2024 [LegCo Brief]

At the meeting of the Executive Council on 28 February 2024, the Council advised and the Chief Executive ordered that the Inland Revenue (Amendment) (Tax Concessions and Two-tiered Standard Rates) Bill 2024, should be introduced into the Legislative Council.

Sustainability Implications: The increase in the deduction ceiling amount for home loan interest and domestic rents and the proposed one-off concession for salaries tax and tax under personal assessment are expected to generate economic benefits to taxpayers through increasing their disposable incomes and to promote social harmony through alleviating their burden in meeting personal expenses. The proposed one-off reduction of profits tax will encourage businesses to make more reinvestment with a view to enhancing their competitiveness.

The sustainability implication of the two-tiered standard rates regime is expected to be limited, because it will only affect a small group of taxpayers.

Loans Ordinance (Chapter 61)
Resolution to Raise the Maximum Amount of Borrowings for the Purposes of the Capital Works Reserve Fund for the Infrastructure Bond Programme and Government Sustainable Bond Programme [LegCo Brief]

At the meeting of the Executive Council on 28 February 2024, the Council advised and the Chief Executive ordered that the Resolution, should be introduced into the Legislative Council to approve the Government to borrow, under section 3(1) of the Loans Ordinance, for the purposes of the Capital Works Reserve Fund (CWRF), sums not exceeding in total $500 billion or equivalent, being the maximum amount of all sums borrowed that may be outstanding by way of principal at any time, with the sums borrowed to be credited to the CWRF for the Infrastructure Bond Programme and the Government Sustainable Bond Programme (GSBP).

Environmental Implications: Further issuance of green bonds under the GSBP will finance a greater number and wider variety of projects with positive environmental benefits, conducive to the Government’s efforts in transforming Hong Kong into a low-carbon economy and achieving the goal of carbon neutrality before 2050. It will signal the Government’s continuous commitment to promoting sustainable development and combating climate change. The proposal will not affect the established mechanism to assess environmental implications in taking forward individual projects.

Sustainability Implications: The proposed expansion of the borrowing ceiling and the expanded scope of the GSBP will fund a greater variety of sustainability projects that will improve the environment and bring positive social impacts. In addition to the environmental implications set out above, the GSBP will also help promote the development of the green and sustainable bond market in Hong Kong.

Public Revenue Protection (Business Registration) Order 2024
Resolution of the Legislative Council under section 18(1) of the Business Registration Ordinance (Chapter 310)
Business Registration Ordinance (Amendment of Schedule 2) Order 2024 [LegCo Brief]

At the meeting of the Executive Council on 28 February 2024, the Council advised and the Chief Executive ordered that a resolution under section 18(1) of the Business Registration Ordinance should be moved in order to raise the business registration fees.

Separately, the Financial Secretary has made the Business Registration Ordinance (Amendment of Schedule 2) Order 2024 to raise the branch registration fees to keep them in line with the business registration fees, and to waive the business registration levy of $150 payable to the Protection of Wages on Insolvency Fund for two years.

Economic Implications: Whilst the proposal will increase the set-up cost or operating cost of businesses, the overall economic implication is expected to be limited. On an annual basis, the additional business registration fee for each new or renewal of business registration is $200 (for one-year certificate) /$173 (for three-year certificate), and the additional fee for each new or renewal of branch registration is $7 (for one-year certificate) / $6 (for three-year certificate) only, which will not disproportionately increase the set-up cost or operating cost of business. In tandem with the proposed levy waiver from 1 April 2024 to 31 March 2026, the financial burden on businesses in the first two years after implementation of the proposed fees should be insignificant. Overall speaking, the proposal is unlikely to discourage business operation or affect the business environment.

Sustainability Implications: It has no sustainability implications other than those set out in the economic implications paragraph.

Rating Ordinance (Chapter 116)
Rating (Exemption) Order 2024 [LegCo Brief]

At the meeting of the Executive Council on 28 February 2024, the Council advised and the Chief Executive ordered that the Rating (Exemption) Order 2024 should be made under section 36(2) of the Rating Ordinance in order to waive rates for the first quarter in 2024-25, with the concession ceiling of $1,000 per tenement.

Sustainability Implications: The measure is expected to generate economic benefits to households and businesses through increasing their disposable incomes and to promote social harmony through alleviating ratepayers’ burden.

On 5 January 2024, the Government gazetted that the Chief Executive in Council had authorised the proposed road works for the public housing development at Tsing Yi Road West (TYRW) in Tsing Yi.

Sustainability Implications: The Scheme aims to support the anticipated traffic generated by the proposed TYRW public housing development, which is conducive to sustainable development including the provision of housing units. Suitable mitigation measures will be implemented to minimize the environmental impacts. The sentiments of the stakeholders would be handled with care.

Approval for Change of Name of Caritas Institute of Higher Education and Post Secondary Colleges to Award Degrees [LegCo Brief]

At the meeting of the Executive Council on 9 January 2024, the Executive Council advised and the Chief Executive ordered that approval should be granted to Caritas Institute of Higher Education (CIHE) to be awarded the university title and change its English and Chinese names to “Saint Francis University” and “聖方濟各大學” respectively; and CIHE, The Hang Seng University of Hong Kong, Hong Kong Chu Hai College, Tung Wah College and UOW College Hong Kong to award degrees.

Sustainability Implications: The proposals to grant the university title to CIHE and approve the five post secondary colleges to award degrees would have positive sustainability and economic implications in widening the institution and programme choices for students and possibly helping nurture more talent, including talent with applied skills that is needed by different industries, although the impact is not expected to be significant.

On 11 January 2024, the Lands Department posted resumption notices and acquisition notices in accordance with relevant ordinances to resume about 109 hectares of land for the implementation of the remaining phase development of the Kwu Tung North/Fanling North New Development Areas (KTN/FLN NDA).

Sustainability Implications: The proposal facilitates the provision of housing units and community facilities and thus will bring benefits to the community and be conducive to sustainable development and economic competitiveness of Hong Kong in the long run. Suitable mitigation measures will be implemented to alleviate the environmental impacts. The sentiments of objectors will be handled with care.

On 19 January 2024, the Government gazetted that the Chief Executive in Council had authorised the modifications to the road works under Hung Shui Kiu/Ha Tsuen New Development Area (HKS/HT NDA) advance works phase 3 and stage 2 works.

Sustainability Implications: The proposed road works will support the anticipated traffic demand arising from the development of the HSK/HT NDA, which will be conducive to sustainable development including the provision of housing units. Suitable mitigation measures will be implemented to minimise the environmental impact. The sentiments of objectors should be handled with care.

Sewerage Works under Hung Shui Kiu/Ha Tsuen New Development Area Advance Works Phase 3 and Stage 2 Works – Site Formation and Engineering Infrastructure and Hung Shui Kiu Effluent Polishing Plant [Press Release]

On 19 January 2024, the Government gazetted that the Chief Executive in Council had authorised the scheme for the sewerage works under Hung Shui Kiu/Ha Tsuen New Development Area (HKS/HT NDA) Advance Works Phase 3 and Stage 2 Works - Site Formation and Engineering Infrastructure; and Hung Shui Kiu Effluent Polishing Plant with modifications.

Sustainability Implications: The Scheme will support the anticipated sewage generated from the second phase development of the HSK/HT NDA which will be conducive to sustainable development including the provision of housing units. Suitable mitigation measures will be implemented to minimise the environmental impacts.

Resumption of Land for Public Housing Development at Tin Wah Road, Lau Fau Shan [Press Release]

On 25 January 2024, the Lands Department posted land resumption notices in accordance with section 4 of the Lands Resumption Ordinance (Chapter 124) and section 14 of the Roads (Works, Use and Compensation) Ordinance (Chapter 370) for the implementation of a public housing development at Tin Wah Road, Lau Fau Shan.

Sustainability Implications: The proposed land resumption will facilitate the Development to provide public housing units and other associated community facilities. Suitable mitigation measures will be implemented to minimize the environmental impacts.

Land Survey Ordinance (Cap. 473)
Land Survey (Fees) (Amendment) Regulation 2024 [Press Release]

On 26 January 2024, the Government gazetted the Land Survey (Fees) (Amendment) Regulation 2024 (the Amendment Regulation) to revise the fees for land survey services provided by the Government in accordance with the established review mechanism.

Economic implications: On economic implications, there will be negligible impact on consumer prices, as the revision only involves trade specific items and mild increases. Sustainability Implications: The Amendment Regulation has no sustainability implications other than the economic implications.

Inland Revenue Ordinance (Chapter 112)
Inland Revenue (Amendment) (Tax Deductions for Spectrum Utilization Fees) Bill 2023 [Press Release]

On 1 December 2023, the Government gazetted the Inland Revenue (Amendment) (Tax Deductions for Spectrum Utilization Fees) Bill 2023 to provide for tax deductions for spectrum utilisation fees payable by mobile network operators (MNOs) on radio spectrum acquired in future auctions, with a view to encouraging MNOs to invest more proactively in telecommunications infrastructure for providing better communications services to business sectors and the general public.

Economic Implications: On economic implications, the proposal should enhance the attractiveness of spectrum bidding by MNOs, and be conducive to the telecommunications and digital infrastructural development of Hong Kong for supporting our long-term economic development.

Sustainability Implications: The proposal has no sustainability implications other than those economic implications stated above.

Telecommunications Ordinance (Chapter 106)
Telecommunications (Amendment) Bill 2023 [Press Release]

On 1 December 2023, the Government gazetted the Telecommunications (Amendment) Bill 2023 to provide legal basis for the Communications Authority to grant authorised access for mobile network operators to install and maintain mobile communications facilities in reserved space in specified new buildings.

Economic Implications: Implementation of the Proposal will facilitate the mobile network operators to establish mobile communications facilities in specified buildings and enhance 5G network coverage across the territory. A comprehensive 5G infrastructure in Hong Kong is pivotal to the development of digital economy and a smart city.

Sustainability Implications: The Proposal has no sustainability (other than the economic implication) implications.

Nurses Registration Ordinance (Chapter 164)
Nurses Registration (Amendment) Bill 2023 [LegCo Brief]

At the meeting of the Executive Council on 5 December 2023, the Council advised and the Chief Executive ordered that the Nurses Registration (Amendment) Bill 2023 should be introduced into the Legislative Council to create a new pathway for admission of qualified non-locally trained nurses, regardless of whether they are Hong Kong permanent residents or not; to make continuing nursing education mandatory requirements for registered nurses and enrolled nurses to enhance the professional competency of nurses; and make other technical amendments to bring the regulatory regime of nurses up-to-date including requiring nurses to provide regular updating of relevant information.

Sustainability Implications: The proposal to facilitate admission of non-locally trained nurses would provide additional healthcare manpower which could in turn improve the provision of healthcare services, and be conducive to sustainable development.

Proposed Incentive Scheme to Encourage Provision of Residential Care Homes for Persons with Disabilities in New Private Developments [LegCo Brief]

At the meeting of the Executive Council on 5 December 2023, the Council advised and the Chief Executive ordered that the proposed Incentive Scheme to Encourage Provision of Residential Care Homes for Persons with Disabilities in New Private Developments (RCHDs) should be introduced to incentivise private developers to provide RCHDs in new private developments to increase the supply of RCHDs on a three-year pilot basis.

Sustainability Implications: The proposal will facilitate the supply of private RCHDs to meet the demand. This is conducive to the sustainable and healthy development of the sector.

Proposed Amendments to the Service Deeds with Gleneagles Hospital Hong Kong and CUHK Medical Centre [Press Release]

On 15 December 2023, the Government amended the service deeds with Gleneagles Hospital Hong Kong and CUHK Medical Centre to enhance the packaged charging and hospital bed requirements, thereby encouraging private hospitals to offer day and inpatient services with more transparency in pricing. A service remedy mechanism is also introduced under the relevant amendments. In case of failure to meet the service deed requirements, the private hospital concerned will be required under the Government's direction to provide services to patients of the Hospital Authority (HA) at the same rates as the HA's standard fees and charges for the benefit of the public.

Sustainability Implications: The proposal will incentivise the operators of the two private hospitals to comply with the committed packaged charging requirement, which dovetails with the Government’s continuous effort to promote price transparency of private hospitals. Besides, the additional remedy mechanism of providing services to patients referred by HA will help alleviate the service pressure of the public healthcare system.

Land (Compulsory Sale for Redevelopment) Ordinance (Chapter 545)
Land (Compulsory Sale for Redevelopment) (Amendment) Bill 2023 [LegCo Brief]

At the meeting of the Executive Council on 12 December 2023, the Council advised and the Chief Executive ordered that the Land (Compulsory Sale for Redevelopment) (Amendment) Bill 2023, should be introduced into the Legislative Council, with a view to expediting redevelopment of old and dilapidated buildings by private sector so as to tackle the safety risk of those buildings and improve people’s livelihood.

Sustainability Implications: As for sustainability implications, the legislative proposals will help expedite redevelopment of old and dilapidated buildings, thus arresting urban decay and bringing long-term benefits to the built and living environment. The resulting supply of new flats with modern design and safety standards will also improve the social well-being and living environment of families.

New Capital Investment Entrant Scheme [LegCo Brief]

At the meeting of the Executive Council on 19 December 2023, the Council advised and the Chief Executive ordered that a new Capital Investment Entrant Scheme (“CIES”) should be introduced. The new CIES should accept applications from eligible persons (covering foreign nationals, Chinese nationals who have obtained permanent resident status in a foreign country, Macao Special Administrative Region residents, etc.) and facilitate the entry for residence in Hong Kong by capital investment entrants, i.e. persons who make investment of HK$30 million or above in the permissible investment assets.

Sustainability Implications: The new CIES would further facilitate the admission of asset owners and talents into Hong Kong to strengthen the development of the financial services industry and the talent pool, which in turn would help enhance the competitiveness of the economy.

On 28 December 2023, the Lands Department posted land resumption notices in accordance with section 4 of the Lands Resumption Ordinance (Chapter 124) for the implementation of public housing development at Ching Hiu Road, Sheung Shui.

Sustainability Implications: The proposed resumption of land will facilitate the Development for providing public housing units and other associated welfare facilities. Suitable mitigation measures will be implemented to minimise the environmental impact.

Country Parks Ordinance (Chapter 208)
Country Parks (Designation) (Consolidation) (Amendment) Order 2023 [LegCo Brief]

At the meeting of the Executive Council on 7 November 2023, the Council advised and the Chief Executive ordered that the Country Parks (Designation) (Consolidation) (Amendment) Order 2023 (the Order) should be made under section 14 of the Country Parks Ordinance (the Ordinance). The Order seeks to designate the Robin’s Nest Country Park (RNCP) with the area shown in the map, which was approved under Section 13(1) of the Ordinance.

On 10 November 2023, the Government published in the Gazette the Mainland Judgments in Civil and Commercial Matters (Reciprocal Enforcement) Rules (the Rules) and Mainland Judgments in Civil and Commercial Matters (Reciprocal Enforcement) Ordinance (Commencement) Notice (the Commencement Notice). The Mainland Judgments in Civil and Commercial Matters (Reciprocal Enforcement) Ordinance (the Ordinance) and the Rules will come into operation on 29 January 2024.

The Ordinance, which seeks to implement the Arrangement on Reciprocal Recognition and Enforcement of Judgments in Civil and Commercial Matters by the Courts of the Mainland and of the Hong Kong Special Administrative Region in Hong Kong, establishes mechanisms in Hong Kong in respect of the registration in Hong Kong of Mainland Judgments in civil or commercial matters and the application to Hong Kong courts for certified copies of and certificates for Hong Kong Judgments in civil or commercial matters to facilitate parties in seeking recognition and enforcement of the Judgments on the Mainland. On the Mainland, the Arrangement will be implemented by way of judicial interpretation to be promulgated by the Supreme People's Court.

Sustainability Implications: The Rules and the Commencement Notice have no sustainability implications other than the economic implications.

Economic implications: As regards economic implications, the Ordinance and the Rules establish a more comprehensive mechanism for reciprocal enforcement of judgments (REJ) in civil and commercial matters between Hong Kong and the Mainland, thereby reducing the need for re-litigation of the same disputes in both places and offering better protection to the parties’ interests. They would enhance certainty and predictability of the cross-boundary enforceability of judgments in civil and commercial matters between the two places, and reduce the risks, legal costs, and time usually associated with the cross-boundary enforcement of such judgments. This would in turn improve the environment for cross-boundary trade and investment.

Further, the breakthrough in expressly including judgments on certain intellectual property rights makes Hong Kong the first jurisdiction to have an REJ arrangement with the Mainland with such a wide coverage. This would help consolidate Hong Kong’s status as a regional intellectual property trading centre as well as a regional centre for international legal and dispute resolution services as outlined in the 14th Five-Year Plan for National Economic and Social Development.

Charging Land Premium at Standard Rates for Lease Modifications – (i) Regularisation for pre-1987 Industrial Buildings; and (ii) Extension to New Territories Agricultural Land [LegCo Brief]

At the meeting of the Executive Council on 14 November 2023, the Council advised and the Chief Executive ordered that the extension of the arrangement for charging land premium at standard rates for lease modifications on two fronts: first, to regularise the arrangement for redevelopment of industrial buildings constructed before 1987 with the scope expanded to cover IBs for special industrial use, and second, to introduce a pilot scheme applicable to agricultural land in the New Territories outside new development areas.

On 17 November 2023, the Government gazetted the Wild Animals Protection (Amendment) Bill 2023 (the Amendment Bill) to expand the scope of the feeding ban to cover feral pigeons, in addition to the current feeding ban on wild animals; increase the maximum penalty for illegal feeding from a fine of $10,000 to a fine of $100,000 and imprisonment for one year; and introduce a fixed penalty system for illegal feeding with the amount set at $5,000. In addition, the Amendment Bill proposes to broaden the scope of enforcement officers of the Government to strengthen enforcement.

Sustainability Implications: The proposal will enhance the conservation of wild animals by raising the deterrent effect against illegal feeding which would alter their behavior / foraging skill. By reducing feeding activities in public places, the proposal will also enhance the environmental hygiene of Hong Kong.

Economic Implications: The proposal will demonstrate Hong Kong’s continued support for international efforts in combating cross-border tax evasion and preventing double non-taxation. This is particularly crucial for Hong Kong to preserve its competitiveness and reputation as an international financial and business centre, and to avoid being listed as a “non-cooperative” tax jurisdiction by the EU.

2. Given that the proposal will mainly affect companies set up by MNE groups in Hong Kong that do not meet the economic substance requirement, the economic impact is not expected to be significant, as these companies by definition do not bring significant economic contributions or many job opportunities to Hong Kong. On the contrary, the proposal may encourage inscope MNE entities which have a limited economic presence in Hong Kong to take certain steps to comply with the economic substance requirement (such as by employing more qualified employees and incurring more operating expenditures in Hong Kong) in order to enjoy tax exemption, or the MNE entities may be prompted to bring transactions in respect of disposal of assets onshore.

Review of Talent List [Press Release

On 16 May 2023, the Government announced the expanded Talent List that increases the coverage from 13 professions to 51 and that immediately applies to the Quality Migrant Admission Scheme, the General Employment Policy and the Admission Scheme for Mainland Talents and Professionals, with a view to attracting more high-quality talent to come and meeting Hong Kong's development needs.

Mandatory Reporting of Child Abuse Bill [LegCo Brief

At the meeting of the Executive Council on 23 May 2023, the Council advised and the Chief Executive ordered that the Mandatory Reporting of Child Abuse Bill ("Bill") should be introduced into the Legislative Council to enhance the protection for children.

Sustainability Implications: In terms of protection for children, the proposal will create a wider protection web for children and a strong deterrent to potential perpetrators that their abuse behaviours will be easily exposed. This also help avoid the harmful consequence of child abuse, including the impact on children's physical and mental health.

Apart from promoting family harmony as mentioned in paragraph 4, the proposal will also increase awareness and reinforce the moral responsibility of the general public to report child abuse/neglect, and help create a child-oriented culture that will not tolerate any abuse of children.

Preparation of Draft Map for The Proposed North Lantau Marine Park [Press Release

On 3 March 2023, the Government gazetted a draft map of the proposed North Lantau Marine Park ("NLMP"). With a view to enhancing conservation of Chinese White Dolphins ("CWDs") and other marine life, the Government proposes to establish the NLMP in the north Lantau waters as the eighth marine park in Hong Kong. The proposed NLMP is located between the Sha Chau and Lung Kwu Chau Marine Park and the Brothers Marine Park, with a total area of about 2 400 hectares.

Sustainability Implications: The designation of the proposed NLMP will significantly increase the area of managed marine habitat which will be conducive to maintaining marine biodiversity, in particular, conserving the CWDs and fisheries resources in Hong Kong.

At the meeting of the Executive Council on 21 March 2023, the Council advised and the Chief Executive ordered that the Road Tunnels (Government) (Amendment) Bill 2023 should be introduced into the Legislative Council.

Economic Implications: The proposed time-varying tolls on private cars and motorcycles would induce some price-sensitive drivers to switch to other transport modes during peak time slots or adjusting their schedules to use the road harbour crossings ("RHCs") during normal / off-peak time slots. This, together with the narrowed toll differences among the three RHCs during peak time slots, should help rationalise crossharbour traffic and alleviate traffic congestion, thereby bringing about some time savings for road commuters. Meanwhile, the proposed uniform tolls during normal and off-peak time slots for private cars and motorcycles, as well as the proposed all-day fixed tolls for taxis and other commercial vehicles across the three RHCs, would encourage drivers to choose the tunnel that best suit their destination and minimise detours.

Sustainability Implications: The proposal is conducive to rationalising cross-harbour traffic with economic implication set out above.

At the meeting of the Executive Council on 28 March 2023, the Council advised and the Chief Executive ordered that the Stamp Duty (Amendment) (No. 2) Bill 2023 should be introduced into the Legislative Council to implement a measure to trawl for talents as announced in the 2022 Policy Address by introducing a refund mechanism under the Buyer's Stamp Duty and New Residential Stamp Duty regimes for non-Hong Kong permanent residents ("non-HKPRs") who have entered Hong Kong under designated talent admission schemes.

Economic Implications: In terms of economic implications, the refund proposal will reduce the cost of property purchase by eligible incoming talents and help increase their sense of belonging and propensity of staying in Hong Kong for good, which is conducive to injecting impetus to the growth of Hong Kong. Although the refund measure may increase the propensity of non-HKPR talents to purchase flats, the requirement that talents could apply for refund only upon becoming HKPR would avoid any sudden upsurge in flat purchases. Hence, the refund proposal would not pose significant impact on the overall residential property market.

Toys and Children's Products Safety Ordinance (Chapter 424)

On 17 February 2013, the Government gazetted the Toys and Children's Products Safety Ordinance (Amendment of Schedule 2) Notice 2023. The Notice seeks to update the safety standards for four classes of children's products, i.e. "bunk beds for domestic use", "child safety barriers for domestic use", "children's high chairs and multi-purpose high chairs for domestic use" and "wheeled child conveyances". On 9 December 2022, the Lands Department announced the resumption of land at Shantung Street/Thistle Street in Mong Kok for the implementation of an urban renewal project.

Sustainability Implications: The proposed land resumption will facilitate implementation of the development scheme, which will replace the poor and deteriorated buildings by new modern buildings, and hence upgrading the local environment. It will also enhance vibrancy of the local economy and create more job opportunities. However, the development scheme may cause transitory disruption to the residents, in particular, to vulnerable groups such as the elderly, as they need to move out and be relocated. Suitable measures will be put in place to minimize the potential transitory disruption.

Enhancing the Talent Admission Regime [LegCo Brief

At the meeting of the Executive Council on 13 December 2022, the Council advised and the Chief Executive ordered that –

  1. launching the Top Talent Pass Scheme;
     
  2. streamlining the existing General Employment Policy and the Admission Scheme for Mainland Talents and Professionals;

Special Scheme to Import Care Workers for Residential Care Homes [LegCo Brief

At the meeting of the Executive Council on 13 December 2022, the Council advised and the Chief Executive ordered that a special scheme should be introduced under section 14(3) of the Employees Retraining Ordinance (Cap. 423) to provide greater flexibility and more streamlined procedures to import care workers in the Residential Care Home ("RCH") sector.

Sustainability Implications: The proposal will facilitate the importation of more care workers to meet the demand from existing and upcoming RCHs. This is conducive to the sustainable and healthy development of the sector.

PWP Item No. 7705TH Sha Tin New Town, Stage 2 - Trunk Road T4 [Press Release

On 16 December 2022, the Government gazetted the Chief Executive in Council has authorised the proposed road works for the construction of Trunk Road T4 in Sha Tin.

Sustainability Implications: The Scheme will help improve the traffic condition of the major road links and junctions in Sha Tin. Suitable mitigation measures will be implemented to alleviate the environmental impacts. The sentiments of objectors should be handled with care.

Proposed road works at Sai Yee Street, Argyle Street, Luen Wan Street and Hak Po Street, Mong Kok, Kowloon [Press Release

On 16 December 2022, the Government gazetted the Chief Executive in Council has authorised the proposed road works at Sai Yee Street, Argyle Street, Luen Wan Street and Hak Po Street in Mong Kok.

Sustainability Implications: The proposed road works would enable the proposed commercial development of the proposed commercial development site of Sai Yee Street, Argyle Street and Luen Wan Street. Suitable mitigation measures will be implemented to alleviate potential environmental impact. The sentiments of objectors should be handled with care.

Approval for Post Secondary Colleges to Award Degrees and for Chu Hai College of Higher Education to Include "Hok Yuen" in its new Chinese name [LegCo Brief

At the meeting of the Executive Council on 20 December 2022, the Executive Council advised and the Chief Executive ordered that approval should be granted to Chu Hai College of Higher Education (CHCHE), The Hang Seng University of Hong Kong, Hong Kong Shue Yan University, Tung Wah College, and UOW College Hong Kong to award degrees; and CHCHE to use "香港珠海學院" as its new Chinese name.

Sustainability and Economic Implications: The proposal to approve the five post secondary colleges to award degrees would have positive sustainability and economic implications in widening the institution and programme choices for students and possibly helping nurture more talent, although the impact is not expected to be significant. As for the proposal to allow CHCHE to include the Chinese words "Hok Yuen" (學院) in its new Chinese name, there should be no sustainability and economic implications.

Hong Kong Innovation and Technology Development Blueprint [Press Release

On 22 December 2022, the Government promulgated the Hong Kong Innovation and Technology Development Blueprint (the Blueprint) to establish a clear development path and formulate systematic strategic planning for Hong Kong's innovation and technology (I&T) development over the next five to 10 years, charting Hong Kong in moving full steam towards the vision of an international I&T centre.

Sustainability Implications: We envisage that the directions and strategies set out in the Blueprint would lay a solid foundation to foster a more diversified economy with a greater contribution of the manufacturing sector to the GDP as well as more job opportunities in I&T and related sectors. All these would be conducive to the sustainable development in Hong Kong.

Wild Animals Protection Ordinance (Chapter 170)
Prohibition on Feeding of Wild Animals Notice 1999 (Amendment) Notice 2022 [Press Release

On 31 December 2022, the Prohibition of Feeding of Wild Animals Notice 1999 (Amendment) Notice 2022 took effect, expanding the places at which the feeding of any wild animal is prohibited (Feeding Ban Area) under the Wild Animals Protection Ordinance (Cap. 170) to the entire territory of Hong Kong with a view to curbing wild animal (in particular wild pig) feeding activities, thereby reducing the nuisance caused by them to the public.

Sustainability Implications: After the expansion of the Feeding Ban Area, we anticipate that wild pig feeding activities will decrease substantially and the nuisance to the public caused by wild pigs will decline. In the long run, wild pigs will no longer rely on feeding by human and will return to foraging in the natural environment. The expansion of Feeding Ban Area could also reduce environmental hygiene problems caused by feeding activities. Apart from the aforementioned impacts, the proposal has no other impacts on sustainable development.

Proposed Free Trade Agreement between Hong Kong and Peru [LegCo Brief

At the meeting of the Executive Council on 1 November 2022, the Council advised and the Chief Executive ordered that Hong Kong should commence negotiation on a free trade agreement ("FTA") with Peru.

Sustainability Implications: The FTA with Peru can, in overall terms, bring more and better access to the Peruvian market, create more business opportunities for Hong Kong businessmen and increase trade and investment flows between Hong Kong and Peru. Enhancing our economic links with Peru will help reinforce Hong Kong's role as an international trade, commerce and financial hub.

Three Land Sharing Pilot Scheme applications endorsed in-principle [Press Release

On 3 November 2022, the Development Bureau announced that the Chief Executive-in-Council has endorsed in-principle three Land Sharing Pilot Scheme ("LSPS") applications with support from the Panel of Advisors.

Sustainability Implications: The endorsement-in-principle to the three applications would help to unlock development potential of mainly privately-owned land, thereby increasing public housing supply to support the continued population growth and developments of Hong Kong. This would also meet the aspirations of the community for effective and prompt actions to tackle the shortage of affordable housing. Relevant assessments have been conducted for individual proposals under the LSPS and may be further refined. Suitable mitigation measures would be put in place to alleviate any environmental impacts so arising. The concerns of the public, in particular the sentiments of stakeholders, should also be handled with care.

Road Traffic (Amendment) (Autonomous Vehicles) Bill 2022 [LegCo Brief

At the meeting of the Executive Council on 29 November 2022, the Council advised and the Chief Executive ordered that the Road Traffic (Amendment) (Autonomous Vehicles) Bill 2022 should be introduced into the Legislative Council.

Economic and Sustainability Implications: The proposed regulatory regime for Autonomous Vehicles ("AVs") would help better monitor the safety, performance and quality of AVs that would potentially be launched on the market in the long term while providing the necessary flexibility for the industry to roll out wider AV trials or use in Hong Kong. The fees for the proposed pilot licence and AV certificate would represent an additional cost of operating an AV relative to conventional vehicles. Nonetheless, this proposal should be conducive to the long-term development of the AV industry and in turn contribute to Hong Kong's transformation into a smart city.

The adoption of AVs is a Smart Mobility initiative promulgated in the Hong Kong Smart City Blueprint. The proposal has no sustainability implications other than economic implications set out in the paragraph above.

On 19 October 2022, the Legislative Council passed the three pieces of subsidiary legislation for enhancing the Plastic Shopping Bag ("PSB") Charging Scheme.

Sustainability Implications: The PSB Charging Scheme provides economic incentive to reduce the indiscriminate use of PSBs. It is in line with the "polluter pays" principle. At its current phase, it has encouraged more sustainable use of natural resources, reduced plastic waste, and enhanced the community's awareness on environmental protection. The proposed enhancement aims to achieve further benefits along the same direction.

Road Traffic (Parking) (Amendment) Regulation 2022, Road Traffic (Public Service Vehicles) (Amendment) (No. 2) Regulation 2022 and Road Traffic (Registration and Licensing of Vehicles) (Amendment) (No. 2) Regulation 2022 [Press Release

On 21 October 2022, the Government gazetted the Road Traffic (Parking) (Amendment) Regulation 2022, Road Traffic (Public Service Vehicles) (Amendment) (No. 2) Regulation 2022 and Road Traffic (Registration and Licensing of Vehicles) (Amendment) (No. 2) Regulation 2022 (the Amendment Regulations). The Amendment Regulations seek to introduce electronic form for the majority of the permits, licences and certificates (collectively referred to as permits) of the Transport Department by issuing them in portable document format ("pdf") and sending them to applicants by email for the applicants to print and display.

Productivity Implications: The Amendment Regulations will be conducive to enhancing productivity as applicants for the relevant permits can choose to receive the permits by email and need not return the e-permits to Commissioner for Transport upon expiry/cancellation, thereby reducing the compliance cost for applicants.

Sustainability Implications: The Amendment Regulations have no sustainability implications other than the said productivity implications above.

Inland Revenue Ordinance (Chapter 112)
Inland Revenue (Amendment) (Taxation on Specified Foreign-sourced Income) Bill 2022 [LegCo Brief

At the meeting of the Executive Council on 25 October 2022, the Council advised and the Chief Executive ordered that the Inland Revenue (Amendment) (Taxation on Specified Foreign-sourced Income) Bill 2022 should be introduced into the Legislative Council to amend the Inland Revenue Ordinance (Cap. 112). The proposal will introduce a new foreign-sourced income exemption regime for passive income.

Economic Implications: The proposal will demonstrate Hong Kong's commitment to supporting international efforts in combating cross-border tax evasion and preventing double non-taxation. This is particularly crucial for Hong Kong to preserve its competitiveness and reputation as an international financial and business centre, and to avoid being listed as a "non-cooperative" tax jurisdiction by the European Union.

The legislative proposal will mainly affect shell companies set up by multinational enterprise ("MNE") groups in Hong Kong presumably for tax reasons. The economic impact is not expected to be significant given the shell companies by their nature do not bring fruitful economic contributions and plentiful job opportunities to Hong Kong. On the contrary, the proposal may encourage in-scope MNE groups which have a limited economic presence in Hong Kong to take certain steps to comply with the economic substance requirement (such as by employing more qualified employees and incurring more operating expenditures in Hong Kong) in order to enjoy tax exemption.

With regard to the proposed adoption of the nexus approach, we consider that there is very limited room and incentives for MNE groups with foreign-sourced intellectual properties income to shift their income to other jurisdictions for tax savings given that the nexus approach is an international standard widely adopted in comparable jurisdictions.

Road Works Ancillary to PWP Item No. 4166CD Drainage Improvement Works at Yuen Long - Shan Ha Tsuen, Lin Fa Tei and Sung Shan New Village [Press Release

On 23 September 2022, the Government gazetted that the Chief Executive in Council had authorised the proposed ancillary road works at Shan Ha Tsuen, Lin Fa Tei and Sung Shan New Village for the drainage improvement works in Yuen Long.

Sustainability Implications: The proposed road works will facilitate the drainage improvement works that alleviate flooding hazards and improve the drainage system up to the current flood protection standard. Suitable mitigation measures will be implemented to minimise the environmental impact.
